Terms of Service

These Terms of Service form a legally binding agreement between you and Mind.Tennis. Please read them carefully before using our platform. By creating an account or using Mind.Tennis, you agree to these terms.

1. Eligibility & Age Requirements

To use Mind.Tennis, you must:

  • Be at least 13 years of age, OR have a parent or guardian create and manage your account if you are under 13
  • Be a human individual (not a bot, script, or automated service)
  • Agree to these Terms on your own behalf, or as a parent/guardian on behalf of your minor child
  • Have the legal capacity to enter into a binding agreement, or have parental authorization to do so

If you are a parent or guardian creating an account on behalf of a child under 13: You are the account holder of record. You accept these Terms on your child's behalf and are responsible for all activity in that account. You acknowledge that you have read and understood our Privacy Policy, including the section on minor data protections.

2. Accounts & Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password โ€” Mind.Tennis staff will never ask for your password
  • Notify us immediately of any unauthorized use of your account at legal@mind.tennis
  • Be responsible for all activity that occurs under your account
  • Not create more than one account per person (duplicates may be suspended)
  • Not impersonate any person or misrepresent your affiliation with any organization

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or engage in conduct harmful to our community โ€” especially conduct that could harm junior players.

3. Junior Player Protections (Under 18)

These protections are mandatory and cannot be waived.

Parental Consent & Linking

  • Players under 18 must have a parent or guardian account linked before accessing certain features
  • The parent/guardian must acknowledge these Terms and the Privacy Policy
  • Parents may monitor all course activity, mental training data, and coaching interactions
  • Account deletion for any minor requires verification of parental identity

Coaching & Messaging

  • Coaches may not solicit private contact information from junior players outside the platform
  • All coach-to-junior communications on the platform include a parent/guardian notification
  • Any coaching content targeting juniors must comply with the ITF Safe Tennis Policy and Tennis Canada safeguarding guidelines
  • Mind.Tennis reserves the right to review communications involving junior players when a safeguarding concern is reported

Purchases

  • Minors may not make purchases independently โ€” payment requires a parent/guardian account
  • Any course purchased for a minor player is accessible through the parent-linked player account

Content

  • All course content available to players under 18 is reviewed to ensure age-appropriateness
  • Minors may not upload profile photos depicting themselves without parental consent
  • Mental training worksheets completed by minors are private and visible only to the player, their linked parent, and coaches they have authorized

4. Our Services

Mind.Tennis provides an online marketplace and delivery platform for mental performance training courses created by qualified coaches and sports psychology professionals. Our services include:

  • Mental training course enrollment and delivery
  • Interactive worksheets and mental readiness tracking
  • Parent/guardian progress monitoring portal
  • Coach communication tools with junior safeguarding features
  • Course creation tools for verified coaches and educators

Mind.Tennis's courses provide mental performance training and education โ€” they are not a substitute for professional psychological counselling, therapy, or medical treatment. 5. Payments, Subscriptions & Refunds

Pricing

  • All prices are displayed in Canadian Dollars (CAD) and include applicable taxes
  • Course prices are set by creators; Mind.Tennis displays them inclusive of platform fees
  • Free courses are clearly marked โ€” no payment information is required to enroll in a free course

Payment Processing

  • Payments are processed securely by Stripe, Inc. (PCI-DSS Level 1 certified)
  • By providing payment information, you authorize us to charge the listed price
  • Mind.Tennis does not store full card numbers; Stripe tokenizes all payment data

Refund Policy

  • Digital course purchases are generally final once course content has been accessed
  • If you experience a technical issue preventing course access, contact support@mind.tennis within 7 days of purchase
  • Refund requests are considered individually. Approved refunds are processed within 5โ€“10 business days
  • Courses purchased for a minor player remain accessible to the parent account after refund review

For Course Creators

  • Creator payouts are processed monthly via Stripe Connect after a 14-day holding period
  • Mind.Tennis retains a platform fee as specified in your Creator Agreement
  • Creators are responsible for any applicable income tax on earnings

6. User-Generated Content

You retain ownership of any content you submit to Mind.Tennis (reviews, worksheet responses, profile information, course materials for creators). By submitting content, you grant Mind.Tennis a non-exclusive, worldwide, royalty-free licence to display and use that content solely to operate the Platform.

You agree not to submit content that:

  • Is false, misleading, or fraudulent
  • Violates anyone's intellectual property rights
  • Contains explicit, violent, discriminatory, or otherwise harmful material
  • Constitutes spam, phishing, or unauthorized advertising
  • Could endanger the safety of a minor

Mind.Tennis reserves the right to remove any content that violates these Terms without notice.

7. Acceptable Use Policy

You agree not to:

  • Attempt to gain unauthorized access to any part of the Platform or other users' accounts
  • Scrape, crawl, or harvest data from the Platform without our written consent
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to send unsolicited communications to other users
  • Attempt to contact junior players outside the Platform to circumvent safeguarding protections
  • Impersonate a qualified coach, sports psychologist, or Mind.Tennis employee
  • Upload course content that is plagiarized or that you do not have the rights to distribute
  • Use the Platform in any way that violates applicable Canadian federal or provincial law

Violations may result in immediate account suspension and, where appropriate, reporting to law enforcement โ€” particularly for any violation involving minors.

8. Intellectual Property

The Mind.Tennis name, logo, platform design, and all original content created by Mind.Tennis are protected by Canadian copyright law and are the exclusive property of Mind.Tennis. Nothing in these Terms transfers any ownership rights to you.

Course content created by coaches and creators remains the intellectual property of those creators, subject to the licence granted to Mind.Tennis in their Creator Agreement to distribute the content through the Platform.

If you believe any content on the Platform infringes your copyright, please contact legal@mind.tennis with details of the alleged infringement. We will investigate and respond within 10 business days.

9. Disclaimers & No Warranties

Mind.Tennis provides the Platform on an "as is" and "as available" basis. To the maximum extent permitted by Canadian law, we disclaim all warranties, express or implied, including:

  • That the Platform will be uninterrupted, error-free, or free of viruses
  • That course content will produce any specific mental performance outcome
  • That the Platform is suitable for any particular purpose
  • Any fitness for athletic, medical, or therapeutic outcomes

Mental training content is educational in nature. Individual results vary significantly. Mind.Tennis does not guarantee that use of the Platform will improve athletic performance, mental health, or competitive results.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Mind.Tennis and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of, or inability to use, the Platform
  • Unauthorized access to your account
  • Any course content or mental training advice provided by creators
  • Technical failures, interruptions, or data loss

In any case, Mind.Tennis's total liability to you shall not exceed the total amounts you paid Mind.Tennis in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any other matter where limitation of liability is not permitted under Canadian law.

11. Termination

You may delete your account at any time through the account settings, or by emailing support@mind.tennis. Account deletion takes effect within 30 days (or 2 business days for minor accounts upon verified parental request).

Mind.Tennis may suspend or terminate your account without notice if you materially breach these Terms. We will make reasonable efforts to notify you of the reason, except where doing so would compromise a safeguarding investigation or violate applicable law.

Upon termination: Sections 8 (Intellectual Property), 9 (Disclaimers), 10 (Liability), and 12 (Governing Law) survive termination of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

In the event of a dispute, we encourage you to first contact us at legal@mind.tennis to seek an informal resolution. If informal resolution is not possible within 30 days, disputes will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

For residents of Quebec: Nothing in these Terms affects any rights you have under the Quebec Consumer Protection Act or other Quebec consumer protection legislation.

13. Changes to Terms & Contact

We may update these Terms from time to time. We will notify you of material changes via email and a notice on the Platform at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance.
